TERMS OF SERVICE
1. GENERAL-Be respectful! I like to speak very casually to clients, if you like a more formal way of comunnication I can stick to it no problem. Poor and rude behavior will not be tolerated and will result in the commission's cancellation.-Please follow the rules and prices detailed in the Commissions tab.-If you fail to follow the rules provided I have the right to decline your commission.-I reserve the right to not have my works sold or distrubted as NFT's, or in any forms of AI databases. By uploading my works to such, you are in direct breach of my TOS.2. PAYMENTS-All commissions must be paid in full upfront.Tips are appreciated but will never be required / asked of you.-There are additional fees for the following: complex designs, lack of visual references, and commissions with a priority deadline.3. REVISIONS-During the sketch process you get 1 revision. These must be sent in a list format.-Once I start the lineart there's no more changes.-During colouring you get 1 more consultation to fix and change the palette, after this I charge $10 (USD) for each extra revision consult.4. DEADLINES AND DELIVERY-Depending on the work I have at the moment and the waitlist, it roughly takes me between 2 weeks - 3 months (Unless specified otherwise in the service description).-A rush fee of $30 - 100 USD may be applied if the commission deadline is within 25 days from when the proposal was made (Price is determined by the complexity of the work in a short turnaround).-Time frames are counted and are communicated before payment is made.5. INTELLECTUAL PROPERTY RIGHTS-I, the artist, hold every right to the produced drawing, not the commissioner.-Therefore I´m allowed to use the copyrighted artwork to;Promote myself in any place or site.-To display it anywhere to my liking.-The only exception to this is to social media platforms such as Twitter or Instagram. I will only post finished pieces on these platforms with your consent, AND with watermarks to prevent theft.-You, the commissioner are allowed to; Use the copyrighted artwork for personal use only unless agreed otherwise. Print the art, and claim the right of their character(s) but not the drawing itself. Use the art to promote themselves with proper credit given to the artist.-If you break the copyright infringement in any way, every right you had to the drawing will be retracted.-A Purchase of Commercial rights to the artwork will always be 200% of original price.-With commercial rights you are allowed to make any sort of merch with the artwork, such as books covers, props, YouTube thumbnails, album art, and change it to your liking and promote your own brand with.-Credit is still required for usage of the artwork, even if altered or edited.-If a piece is originally purchased for personal use, and the client later decides to purchase commercial rights, you may consult / message me at any time to purchase those rights.-I do NOT wish to have myself or my art affiliated with AI art in ANY way.6. REFUNDS-You have the right to cancel the commission ONLY if I haven't started working on your piece, even the sketch stage AND if I don't keep my word in the following: time limit and rude behaviour.-I will NEVER cancel a commission without communicating with the client first. Artist cancellations are rare, but may occur if I am unable to complete the commission for whatever reason, or if I feel mismatch between client / artist (attitude, miscommunication, etc).-Refund amounts correspond with the state of the commission at that time of refund request, as well as who requested the refund.-Commissions that are canceled by you without being started are subject to a 95% refund. Consider the other 5% a cancellation fee.-If you file a chargeback against me, your right to everything I have ever made for you will be retracted and I have the right to sell the copyrighted artwork to new buyers, and you will be blacklisted.-Any statement can be bound to change if discussed with me, the artist, prior to the commission.
